What is grant of status of residence?

  • It refers to the child of a foreigner who was born in Korea and receives the status of residence.

 

When to apply for grant of status of residence

  • Those born in Korea must apply for grant of status of residence within 90 days from the date of birth.

  • If you do not apply for the grant of sojourn status within the deadline from the date on which the reason for granting the sojourn qualification occurred, a fine will be imposed as a violation of the Immigration Control Act.

    ※ Foreigners born in Korea who are subject to grant of sojourn qualification and who depart within 90 days may leave the country without being granted sojourn qualification.

Criteria for Granting Permanent Residence (F-5) Sojourn Status

  • Children of foreigners who hold permanent residency (F-5) status are granted permanent residency status (F-5).

Eligibility for Permanent Residence (F-5)

  1. If both spouses are permanent residents, their children may be eligible for permanent residency visas.

  2. If the father is a permanent resident and the mother's visa is F-4, H-2, etc., the date of marriage registration must be earlier than the date of conception. If the date of conception is earlier than the date of marriage registration, immigration may request genetic testing of the father and the child born.  

  3. Conversely, if the mother is a permanent resident and the father has a visa for other sojourn statuses, if the father is a legal resident, the birth child can receive a permanent resident visa without any special difficulties.

  4. In an unusual case, the mother is a permanent resident, but if the father does not have a valid visa, the child's residence status will unfortunately go down one level to the F-2 visa.
